Terms of Service — Firsty Builders

1. Acceptance

By accessing or using Firsty Builders (the "Service"), operated by Firsty B.V. ("Firsty", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The service

Firsty Builders provides programmatic access to mobile connectivity products, including eSIMs, voice calling, and phone numbers, via API and a hosted sandbox. The Service is intended for businesses integrating connectivity into their own products.

3. Accounts

You must provide accurate information when creating an account. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable use

You agree not to (a) resell raw connectivity without integrating it into a value-added product, (b) use the Service to send spam, fraud, or unlawful traffic, (c) reverse engineer the platform, or (d) circumvent rate limits or security controls.

5. Sandbox and trial credit

Sandbox accounts are issued free of charge with a limited credit allowance. Inactive sandbox credentials may be reclaimed after 30 days of inactivity. Sandbox is provided "as is" with no SLA.

6. Orders and payment

QR code orders are billed in EUR via Stripe and are non-refundable once eSIM activation codes have been generated, because each code is single-use and irrevocable. Pricing is shown at checkout.

7. Service level

We aim for high availability of the production API. Maintenance and incidents are communicated via status updates. Beyond paid SLA agreements, the Service is provided without warranty of uninterrupted operation.

8. Limitation of liability

To the maximum extent permitted by law, Firsty's aggregate liability for any claim arising out of the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

9. Termination

Either party may terminate use at any time. We may suspend or terminate accounts that violate these terms or applicable law.

10. Governing law

These terms are governed by the laws of the Netherlands. Disputes will be resolved in the competent courts of Amsterdam.
